Spice World Social Media Sweepstakes Official Rules

Participation in the Spice World Social Media Sweepstakes (“Sweepstakes”) constitutes participant’s full and unconditional agreement to and acceptance of these Official Rules. THIS SWEEPSTAKES IS NOT AFFILIATED WITH FACEBOOK, INSTAGRAM, OR ANY OTHER SOCIAL MEDIA PLATFORM. THIS SWEEPSTAKES IS NOT AFFILIATED WITH CALPHALON OR ANY OTHER BRAND OR RETAILER. ALL QUESTIONS REGARDING THE SWEEPSTAKES SHOULD BE DIRECT TO SPONSOR AND NOT THE SOCIAL MEDIA PLATFORM.

Sweepstakes Period:  The Sweepstakes begins at 12:00:01 AM Eastern Time on November 3, 2023 and ends at 11:59:59 PM Eastern Time on November 22, 2023 (“Sweepstakes Period”). 

Sponsor: The Sweepstakes is sponsored by Spice World, Inc. (“Sponsor”).

Administrator: The Sweepstakes administrator is Marbury Creative Group (“Administrator”).  

Eligibility: The Sweepstakes is open to natural persons 18 years of age and older who are legal residents of the 50 United States and Washington, DC (“Participants”). Employees, officers, and directors of Sponsor and Administrator, and all of their respective parents, subsidiaries, members, divisions, affiliates, advertising, promotion, and fulfillment agencies (“Sponsor and Promotion Parties”), and those individuals who are immediate family members of Sponsor and Promotion Parties, or persons living in the same household as Sponsor and Promotion Parties, are not eligible to participate in the Sweepstakes. “Immediate family” means parents, siblings, children and spouse. Void where prohibited. All federal, state, and local laws and regulations apply.

How to Enter:  During the Sweepstakes Period, Participants can enter by taking the following actions:

Prize:  One (1) winner (“Winner”) will receive (a) one (1) Calphalon Premier™ Hard-Anodized Nonstick Cookware, 11-Piece Pots and Pans Set, Model: 2172320 retailing at $480. Total prize ARV is $480. No substitution or transfer of any prize or election of cash in lieu of any prize by Winner(s) will be permitted. Sponsor is not liable for prizes lost or damaged while in transit. Sponsor reserves the right to substitute any prize of equal or greater value. Prizes are nontransferable. All federal, state, and/or local taxes are the sole responsibility of Winner(s). Winner(s) will be issued an IRS 1099-MISC tax form for the prize retail value, if applicable.

Winner Selection; Odds: Promptly following conclusion of the Sweepstakes Period, Sponsor or Administrator will select, via a random drawing, Winner(s) from all eligible entries received during the Sweepstakes Period. Selected Winner(s) will be notified by e-mail. Odds of winning depend on the total number of eligible entries received. In the event of a dispute over the identity of the selected Winner, the Winner will be deemed to be the Authorized Account Holder of the email address used at registration. “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an Internet service provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. To be awarded a prize, selected Winners may be required by Sponsor to sign and complete an Affidavit/Release and return it within five (5) days of the date of the selected Winners’ receipt of prize award notification. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to deliver the notification to selected Winners. If a selected Winner cannot be contacted or fails to claim a prize within two (2) days of the drawing, is ineligible, or fails to timely return the completed and executed Affidavit/Release as required, the prize may be forfeited and awarded to an alternate Participant who will be randomly selected from the remaining eligible entries. If selected Winner has moved to a different address, it is the sole responsibility of the selected Winner to notify the Sponsor or designated agent of the selected Winner’s new address. Sponsor is not responsible for any undeliverable prize deliveries due to change of address. 

Rights Granted to Sponsor: By entering this Sweepstakes, Participants understand and agree that Sponsor and Promotion Parties, anyone acting on behalf of Sponsor and Promotion Parties, and Sponsor and Promotion Parties’ licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, Participant’s entry, name, portrait, picture, voice, likeness, image, statements about the Sweepstakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes, without any further compensation, notice, review, or consent. 

General Conditions and Release: By participating in the Sweepstakes, Participants agree to be bound by these Official Rules and the decisions of Sponsor and Administrator, which shall be final. Sponsor and Promotion Parties, agents and representatives of Sponsor and Promotion Parties, their parent companies, members, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, are not responsible for and shall not be liable for: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) failed, incomplete, garbled, or delayed computer transmissions; (iii) any condition caused by events beyond the control of the Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (iv) any injuries, losses, or damages of any kind arising in connection with or as a result of any prize, or acceptance, possession, or use of any prize, or from participation in the Sweepstakes; or (v) any printing or typographical errors in any materials associated with the Sweepstakes. Sponsor reserves the right, in its sole discretion, to suspend or cancel the Sweepstakes at any time if a computer virus, bug, tampering, unauthorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of the Sweepstakes. Sponsor reserves the right to cancel the Sweepstakes or change any element thereof, with or without notice, at any time, due to printing errors, web site errors, transmission errors or other mistakes or problems in the production or administration of the Sweepstakes. Sponsor also reserves the right to disqualify, in its sole discretion, any person tampering with the entry process, the operation of the website, or who is otherwise in violation of the rules. 

By participating, each Participant agrees to release and hold harmless Sponsor, Promotion Parties, Instagram and Facebook, and their employees, officers, directors, agents, representatives, parents, members, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, from any and all losses, damages, rights, claims and actions of any kind in connection with the Sweepstakes or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Entries become the exclusive property of the Sponsor and will not be returned. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW.

Choice of Law and Forum; Class Action Waiver: Participants agree that all disputes relating to the administration of the Sweepstakes or issuance of any prize will be resolved in the appropriate courts in the state of Florida, exclusively, and subject to the laws of the state of Florida, without regard to conflicts of laws.  Participant agrees that causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action, exclusively before a court located in Florida having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses. Participant further waives all rights to have damages multiplied or increased.

Winner’s Names: The names of the Sweepstakes Winner(s) will be posted to Sponsor’s Instagram and Facebook accounts by way of update the original post announcing the Sweepstakes.  Those posts will be left up and available for viewing for at least one (1) month following the conclusion of the Sweepstakes Period.
